Coordination on European litigation

National Law on the participation of Italy to the EU legislation process (No 234/12) entrusts the Presidency of the Council of Ministers (Department for European Policies) and the Ministry of Foreign Affairs and International Cooperation with the Government’s decision to intervene in the proceedings raised before the Court of Justice of the European Union, in defense of situations of particular national interest.

To this aim, the Department convenes regularly coordination meetings aimed at networking the involved administrations and the Avvocatura Generale dello Stato*. Such action is ensured in cooperation with the Ministry of Foreign Affairs and the Agent of Government before the EU Court of Justice.

Main objective of this coordination effort is to prevent or reduce potential litigations before EU justice bodies and provide the Avvocatura* with the necessary tools for the drafting of defense statements.

 

*The Avvocatura Generale dello Stato is the State's legal organ in charge of providing legal advice and defense to central administrations and representing the State in any civil, criminal or administrative lawsuit. It is not charge of prosecution.
